    Scales -- It's always fun to be in your sights, but this time, on Mary Beth Kelly, you've got it wrong, at least from a rule of law perspective.  In the EM petition case, MB Kelly found that "substantial compliance" is not enough, that there must be actual compliance with the statutory requirements.  That is a rule of law standard that the majority embraced.  MB Kelly then found -- on the basis of the record -- that the statute had been complied with; three other justices argued that the record was insufficient and the matter should be remanded to the Board of Canvassers.  

    I don't like the result any more than you do, but it wasn't a departure from the rule of law that resulted in the decision, it was a finding on the sufficiency of the evidence, which is within the judicial function.
