    Kevin, that's a good question, and one I haven't looked up.  I would say that a majority of the cases before the Court of Appeals probably don't involve a decision that implicates "rule of law."  They would mostly be cases involving the sufficiency of the evidence or application of common law rules and standards.  Instances in which a statute is being interpreted and there is a true "rule of law" vs. "empathy" decision are probably somewhat rare.  I will try to find out, however.

    One other thing -- I have not searched Judge Markey's decisions exhaustively (though I do have a couple more to write about).  Also, I am not familiar with the "Westlaw Review" and its ranking methodology, so I appreciate the opportunity to look that up and learn something new.

    Lastly, your post about the "circular firing squad" is important and well-taken.  Sometimes, we conservatives forget that, once the primary is over, whomever we select is likely to be head and shoulders above the opposition.  Teamwork wins games and elections.

    Back in 2010, the Republican Justices all got on stage and endorsed Kelly.  Clearly something is off with Markey if they made that unprecedented move to unanimously publicly endorse  Kelly over Markey.
