    "The Department of Environmental Quality [DEQ] Motion to Dismiss our Case against them will be heard tomorrow."

    If you don't recall what this is about, go back three months.

    This was a case that should have had a determination against the DEQ by its original absence. Of course the same Judge (Carras) presiding is expected to offer a fair and impartial opinion on the matter.

    Some interesting info from the plaintiffs below the fold

    Particcularly interesting is the authority that has been 'assumed' by the DEQ outside its original charter.
    The DEQ has threatened to enter our land and control activities on our land.

    We have found that it is critically important that the people monitor our judicial system or what is said in court, going into some file draw to never be made public. Please if you can, plan to attend this Hearing and bring a friend. THE STATE DEPARTMENT OF ENVIRONMENTAL QUALITY (DEQ) wants to have our case dismissed because they don't want to answer two simple questions:

    1)    Question of Statutory Law

    MCL 324.503  "The department [DEPARTMENT OF NATURAL RESOURCES] has the power and jurisdiction over the management, control, and disposition of all land under the public domain,"

    MCL 324.301  "Public domain" "means all land owned by the state"

    No other power or jurisdiction was given to Dept. of Natural Resources by Legislators

    2)    Constitutional Question of Law

    We have a contract for our land signed by President of the United States granting ALL Rights, privileges, immunities, and appurtenances to our land of whatsoever nature... forever

    Constitution of the United States & State of Michigan Article I; Sec. 10                              

    No Law shall be passed impairing the Obligation of Contracts

    It is important to all of use to see that the State address and answer these two simple questions.
