    You know there will be a great deal of political action in the near future, and as 2010 rolls through we will still be stuck with two of the most incompetent senators.  

    Unless... we take the opportunity to reflect on the constitutionality of their voting records, and base a recall effort on their failure to abide by their oath of office:


    "I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God."

    A recent (final?) ruling in US District may affect these two, and I just felt the need to get some people thinking..

    The real deal for Michigan was the recall of Andy Dillon and the push by Rose Bogaert to remove Dillon based on his role in the state tax hikes of 2007.  (as an aside these were the tax hikes that woke me up..)

    The Ivory Tower reporting on Saturday that the ban on circulators from outside the targeted districts has been tossed:

    "Judge Robert Holmes Bell found that requiring a petition circulator in a recall campaign to live in the district of the targeted officeholder violated the First Amendment because it substantially limited the pool of people who might participate.

    Bell's decision is in line with several recent cases striking down state rules on petition-gathering that some elections officials fear makes the process more vulnerable to fraud and abuse. Petition signature collecting has been a growth industry in the last decade, with professional collectors traveling from state to state to work for whoever would pay them."

    If they can steal our money, give it to their supporters, and their supporters can organize for them.. Fair is fair right?

    The sad truth of the matter however, is that recalls are a tragic way to deal with elected official, but sometimes there can be little choice when given the alternative and further destruction to a state already ruined by devastating "leadership."  Recalls are hard enough a process, and this clears the way for more positive outcome possibilities.

    But if not for the efforts of Rose, and Leon Drolet, and all involved in the Dillon recall effort, there might not be this ray of sunshine on the cloudy politics in Michigan.

    Thank you Rose for sticking it out.  Most will not understand how much of a P.I.T.A. it was, but you efforts do not go unnoticed.

    It's good to read about someone willing to stand up and go the extra mile to removing roadblocks to Michigan recovery.

    It's even better to read about the process being made easier.

    Yes, the fish paper will kvetch and moan about it.

    They like taxes.

    To them, raising taxes when times are tough is about as natural to them as breathing.

    They will also leap in front of the proverbial bus, if it will mean to help protest those who feel the same as they do.

    We definitely could use more people like Rose & Leon!

    There is no provision in the US Constitution that allows for the recall of holders of elected Federal Office such as Congressional Representitive and Senator. State law does not apply in these cases even if there is a State Constitutional provision for recall it pertains to State Office holders only. An amendment would have to offered and ratified by 2/3 of the states in order to provide for this action. I would love to see this happen along with term limits for all elected and appointed federal positions. This would include members of Congress, Federal Judges including Surpeme Court appointees and even President and Vice President. Recall can have a very good effect on the behavior of the elected class. But when coupled with term limits we can end the hold of the permanant political class on the throat of this nation. Return to the idea of the citizen legislator and end the dirty deals and back room alliances that serve the few to the detriment of the many.

    I thought you were writing about Levin and Stabenow!  Levin and Stabenow are both ineffective and incompetent.
